As soon as we have confirmation of date and time and location/route, I will send out newsletters to all CA, NV, AZ and OR members who wish to participate. This is going to be good.
Sure, I will join the tomorrows march organized by fightnow. Since it is short notice for many IV members there may not be many of us there, but please feel free to join if you can. There are lot of IV members in San Jose.

A note to my fellow IV members - I am not after the $42/Hr job. Good luck in finding a US citizen to do this job. I was wrong about EEO, it is actually IRCA which prohibits discrimination in recruitment and hiring.

But the point remains - visa status based discrimination is illegal not matter which law is being violated, and must be highlighted. We have to correct the misinformation spread by anti-immigrant groups that most jobs are "reserved for H1Bs", while the reality is different. Most jobs are "reserved" for American workers (although such reservation is illegal under IRCA). We have to provide the proof that the myth of "thousands of jobs reserved for foreign workers" in nothing but a myth. My posting is a small step in that direction.
Here is another one in the continuing series of exposing the highly prevalent illegal hiring practice. I request everyone to start posting similar job-ads you get from recruiters. Once we get a hundred or more ads here, we can start E-mailing the links to the media.

I tend to disagree from you on your comment regarding a possible link between name check and FP. I think they are seperate processes and run in parallel - one does not depend on another. I've read somewhere that a guy's name check was initiated like a month before he went for his FP. He got that info from infopass appointment. Also, wouldn't the IOs mention about the pending name check if it was related to FP notice?
Regarding reaching a non TSC IO, I think is impossible since the call gets directed to TSC or NSC based on the receipt number that you key in when you call.
I agree with you that we'll end up getting the same damn letter as our friend about no appointment availabality at local ASC for our SR response. It seems to me that we have to try either the Infopass or just wait it out.

I took an infopass appointment today. The IO sent an e-mail to NSC after taking details like DOB, address etc. for me and my wife.
btw, FP for us has been scheduled. Looks like they have some kind of a queue for that but a notice has not been sent out.
So that was it. Am going to wait it out patiently.

Retaining your PD, using a new I-140, is not the same as Labor substitution. There are several members who have successfully ported their PD, and may be able to advise you better.

Anyway, moving forward...It will be nice to make a list of desirable points in a bill that is independent of any cause for illegal immigrants. I will start with two points. You can add more if you like. If there is enough momentum and support for these points, then in a truly democratic environment, we may want to modify the core IV goals to reflect that (Ideally I would prefer that there be a vote for what should be the core goals...after all most people here have contributed something towards the cause...and only those who have contributed should be allowed to vote...no free lunch).
1. Allow people to file for 485 and get EAD even if visa numbers are not available
2. Allow EAD to be FULLY portable without restrictons (i.e., irrespective of job description or job title or job location or salary).
The above two dont ask for sweeping changes in immigration laws such as increase visa numbers etc. etc. and are easy for the average American person to understand. And so can hopefuly be passed easily.
With the above two passed, I dont think many people will complain if it takes another 5 years to get their GC. Agree?
By the way, I have got my EAD card and my PD is also current. So the above two goals will be redundant for me. My story is that I am stuck in FBI namecheck. But the moderators have already indicated that it cant be one of the core goals. So I would not list that even if I would like that to be one of the core goals.

People who have read my posts know my admiration for India and my belief that it will be Americans who will fight to get a job there one day. The numbers I shared are not "blinding me by my own bias" like you say at all. I fact, I used numbers in order not to be biased and rather to be fair. I just responded to some ignorant comments by some people. I have been to India and hope to go back, and have many great friends from there. What discouraged me is that some people will attack my country especially in a forum where that doesn't belong and where we are all trying to help each other. Any divisions among us are a victory for our detractors. I hope you understand. Let's focus on helping each other going forward, and let's all be friends! Thanks.

You will see a date on I-485 only if you filed I-140 & I-485 concurrently. Even my I-485 does not have any priority date.

Yes, case was originally filed at NSC on July 2nd and on august 24th it got transferred to TSC.
Does the transfer matter here, because dingudi's case is not a transfer case and he's still waiting...

My attorney received my receipts as well as my wife's receipts...they sent me scanned receipts....PD Mar 2005...hand delivered to NSC on july 2nd...Received EAD 10 days ago...I-140 is from TSC...had a LUD on 5th august.....Receipts starts from SRC...it got transferred to TSC from NSC.. Received Date is July 2nd...Notice Date is August 14...
