I immediately prayed for your welfare and peace...somehow I got a flash inside me saying that " you will live beyond 4-6 months and something will work out for you""

What happens when 485 is pending for more than 180 days and a person already used EAD for his current JOB(because of the policy of the Employer saying that: Once they apply for EAD employee needs to use EAD and company will not extend H1B anymore). Eventually employee will use EAD.
The he loses his JOB(with Current Emlpoyer who is the sponsorer of 140 & 485)? And say he remains without similar JOB for example 2-4 weeks and then finds a JOB with similar JOB description? Does he still remain on Adjustment of Status? Does he needs to be continuously employed till his 485 is adjudicated?
Please provide some input. All your opinions would help many folks!

Guys one more perspective:
1) Employers are not in the business of litigations. Their business is to run the company. If you or the employers are talking lawsuits then one of you have crossed a red line. It is just that. No sensible person goes to the court knowing he has done wrong. I doubt an employer wants lawsuits. Just like you feel threatened by lawsuits, your employer also feels threatened by lawsuits.
2) Surabhi - nothing personal, but your post reflect how the ideal world should be. However world is not your way always.
3) I agree with acquarian, that it is very stressful if employer threatens to sue you. Also attorneys will charge you $200/ per hr. If someone is saying that attorneys recover money later etc, I say chill. Most attorneys would not do that. They like hourly rates. Its very difficuilt to find an attorney for free unless your case is slam dunk.
Why I suggested he apologize? Be humble. I did not say admit your mistake. I just said aplogize for employers grievance. If two simple words "I apologize" can get your job done, why waste time in attorneys court, etc?

Hello All,
Talked to my lawyer today about the checks; they have been encashed for myself and my spouse on 9/4. My RN starts with SRC.
My I-140 was approved from Texas and my AOS/485 was mailed on july 2nd and arrived on july 3rd to NSC.
Just a curious question for those you have already received their RN#. When checking the case status it displays "I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS "...will this message change when EAD has been approved and mailed?

in essense...what you are saying is that if one has paystubs that one can change after the 180 day period even if 140 is not approved...

They said they will send email to TSC & hopefully I should get the FP in next 30 days , if not I should come again which I did. This time they did the same email thing .Actually I went 2nd time to know whether my NC was clear or not. Menwhile I had created 2 SR's by calling USCIS too.

I landed in Jan08 thru Windsor border in Michigan. I drove in my car to CA. You'll go to the immigration officer who'll check your landing docs, and then ask you to sign the landing document. Then show them the proof of funds. I had a cashier's check for the amount. Then you'll be asked for an address in CA. If asked tell them you are planning to settle at the address. If you say you are returning to US, they'll not give you the PR card saying when you come to live in CA they'll issue it. I made that mistake. They stamp your passport with the entry stamp. Without a PR card you can't enter CA at an airport. Your only option is driving to CA thru a land border. They'll let you in with just the stamp on the PP. Fortunately I live close to Windsor border.
As someone pointed out, you'll then go to customs, where they'll check the goods you are bringing or plan to bring later. There are 2 different forms for 'bringing goods with you' and 'goods to follow'. Make sure you fill in all the item in your home on the 'goods to follow' with some details like model number, etc. If you are not planning to live to CA, don't fill anything on the 'bringing goods form.

With out IV, The only two things folks on the hill knew were illegal immigration and H1B visa. Now more than 75% offices know the EB issue inside out and have a position on it. This is an effort that needs to be continued until we get a solution.
This in itself is a stupendous achievement and IV has made it possible. 2 or 3 years back you had NO VOICE. Now you have IV. Thats enough reason contribute and feel involved in the community effort.

Cornyn bill as I read it is better than the other bills for US Masters holders in non STEM area ex someone like myself with an MBA.
As far as I read it basically it says to be quota exempt you should
1) Have Masters or higher from US Univ.
2) Have Masters in STEM and 3 yrs exp. (even if Masters is from outside US).
So based on this logic even if someone has MA in English from US Univ they will be quota exempt, correct ???

Let me answer that. I am from Fiji but I was born in India so I am stuck with rest of you and for my family going back is not an option. Fiji is very hostile to indians living there so for us it's here or nowhere. May be india is an option but we have very few distant relatives in India as both of our parents has passed away.
Though it is a big shock for me and my family, I have to get over it and think about their survival after me.
My apologies if I have given the impression as GC greedy but I can understand how difficult it is for someone to understand how is life without something you can call a "Home"

May be just may be because TSC approved a lot of cases for the current PD 2 years ago and have less cases than NSC.

All mine and my spouse's applications were transfered to Vermont. my I-140 was approved from TSC. My checks were cashed on July17th and that is how I know that it is pending at VSC.
Yesterday I got an email that Card production ordered for EAD. All applications applied on July 6th. I am not sure on what basis they transfered. But it looks like Vermont has started approving the EAD cards. Hopefully, I will get it soon too in the mail.

Please whats all these arguments about? MS from the states, BS + 10 years experience etc. Please we don't need all these. There are people that come to the states and dont even pay a dime in tuition instead they even get paid - in the form of research assistanships and scholarships.
Whatever the case, it is not fair to come to the US work for a long period of time and then get thrown out (say after 6 years) like the H1B visa.
What we need to concentrate our energy and efforts on is for congress to create a PATH for SELF SPONSORSHIP of GCs. For example, if u have lived LEGALLY in the US for 5 or more years, paid taxes and stayed out of troble then you should be able to apply for a green card. The way it is now, there is no hope. Everything is uncertain. We are living uncertain lives. If we get sacked, we dont even know what step to take next. It is so dipressing and furstrating. Thats exactly what it is tempoary workers living TEMPOARY LIVES. Some are just waiting until 6 years H1 B expires and then .... yes and then what?? They dont even know. As it is most employers are unwillingly to sponsor GC. Why go through all the troubles??
Of course a lot of guys have gone ahea and gotten married just to get GC and which brings back the question... who is the system designed for? Those who struggle to abide by the law or those who take the short but fraudlent route. Your guess is as good as mine.
So this is what we should be fighting for... a PATH in such a way that you can SELF SPONSOR and not frivolous arguements between ourselves..... Spread the word!
Whatever the case, it is not fair to come to the US work for a long period of time and then get thrown out (say after 6 years) like the H1B visa.
What we need to concentrate our energy and efforts on is for congress to create a PATH for SELF SPONSORSHIP of GCs. For example, if u have lived LEGALLY in the US for 5 or more years, paid taxes and stayed out of troble then you should be able to apply for a green card.
